InfoTelesys iT Set’s come with a 1-year limited hardware warranty.

What is covered by this limited hardware warranty?

This limited hardware warranty covers defects in materials and workmanship in your InfoTelesys iT Set.

What is not covered by this limited hardware warranty?

This limited hardware warranty does not cover:

· Software, including without limitation the operating system and software added to the iT Set through our factory-integration system, third-party software, or the reloading of software, or upgrades to the operating system

· Non-InfoTelesys branded products and accessories

· Problems that result from:
-External causes such as accident, abuse, misuse, or problems with electrical power
-Servicing or tampering not authorized by InfoTelesys
-Usage that is not in accordance with product instructions, including scratching or breaking the touch screen
-Failure to follow the product instructions or failure to perform preventive maintenance
-Problems caused by using software, accessories, parts, or components not supplied by InfoTelesys
-Products with missing or altered Service Tags or serial numbers
-Products for which InfoTelesys has not received payment
-Normal wear and tear, including wearing down the battery or touch screen

INFOTELESYS'S RESPONSIBILITY FOR DEFECTS IN MATERIALS OR WORKMANSHIP OR MALFUNCTIONS IS LIMITED TO REPAIR OR REPLACEMENT OF THE PRODUCT AS SET FORTH IN THIS WARRANTY STATEMENT. EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY STATED ABOVE FOR INFOTELESYS PRODUCTS, INFOTELESYS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY (1) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, SUITABILITY, OR NON-INFRINGEMENT; (2) RELATING TO ANY THIRD PARTY PRODUCT OR SOFTWARE; OR (3) REGARDING THE RESULTS TO BE OBTAINED FROM THE PRODUCT OR SOFTWARE. INFOTELESYS EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS LIMITED WARRANTY.

WE DO NOT ACCEPT LIABILITY BEYOND THE REMEDIES PROVIDED FOR IN THIS LIMITED HARDWARE WARRANTY OR FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY FOR THIRD-PARTY CLAIMS AGAINST YOU FOR DAMAGES, FOR PRODUCTS NOT BEING AVAILABLE FOR USE, OR FOR LOST OR DAMAGED DATA OR SOFTWARE. INFOTELESYS DOES NOT WARRANT THAT THE OPERATION OF ANY INFOTELESYS PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. OUR LIABILITY WILL BE NO MORE THAN THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT THAT IS THE SUBJECT OF A CLAIM. THIS IS THE MAXIMUM AMOUNT FOR WHICH WE ARE RESPONSIBLE.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION).
NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER THE LIMITED WARRANTY PERIOD HAS EXPIRED.

How long does this limited hardware warranty last?

This limited hardware warranty lasts for one year of the earlier time period indicated on your packing slip, invoice, or receipt

The limited hardware warranty on all InfoTelesys-branded products purchased directly from InfoTelesys or from an InfoTelesys Get IT Companies, begins on the earliest date of the packing slip, invoice, receipt, or other sales documentation. For products purchased from third party retailers or resellers, the limited hardware warranty begins on the date of your original sales receipt. The warranty period is not extended if we repair or replace a warranted product or any parts. InfoTelesys may change the availability of limited hardware warranties, at its discretion. All changes to this warrantee shall be posted on www.infotelesys.com/support for the relative product model

What do I do if I need warranty service?

Before the warranty expires, contact InfoTelesys on the support section of the www.infotelesys.com/support

If you purchased through a retailer (not directly from InfoTelesys), you may be required to provide InfoTelesys with your original sales receipt from your purchase to receive any warranty service from InfoTelesys.

What will InfoTelesys do?

Prior to contacting InfoTelesys, please consult your Owner's Manual and the www.InfoTelesys.com/support site for troubleshooting advice and directions on running hardware diagnostics.

Upon contacting InfoTelesys technical support, you may be required to engage in a remote diagnosis session with the tech support agent to help determine the cause of your issue. Remote diagnosis may involve multiple or extended communication. If the InfoTelesys technical support agent determines that your issue is the result of a defect in materials or workmanship but the issue is not able to be resolved remotely, InfoTelesys, at its sole discretion, may dispatch a replacement part to you or arrange for you to send your product or defective part back to InfoTelesys' repair depot, or replace the product with a comparable product that may be new or refurbished.

If we determine that the problem is not covered under this limited hardware warranty, we may be able to offer you service alternatives on a fee basis.

Replacement parts and products are covered for the remaining period of the limited hardware warranty for the product you purchased. InfoTelesys owns all parts removed from repaired products and, in most instances, you will be required to return defective parts to InfoTelesys.

InfoTelesys may use authorized representatives to provide any of the technical support or repair services under this limited hardware warranty.

Important Information about Returning Products to InfoTelesys for Repair or Replacement:

Upon a determination by an InfoTelesys technical support agent that your product should be returned to InfoTelesys for repair or replacement, we will issue a Return Material Authorization Number and Instructions which you must include with your return. You must return the products to us in their original or equivalent packaging, and prepay return shipping charges, and insure the shipment or accept the risk if the product is lost or damaged in shipment. We will return the repaired or replacement products to you as soon as the product is repaired and if not repairable as soon as a replacement product is available. In some instances if a replacement product is not available, InfoTelesys at its sole discretion may offer you an equivalent or superior product in return.

NOTE: Before you ship the product(s) to us, make sure to back up the data on the device and remove any confidential, proprietary, or personal information and removable media such as SD Cards. We are not responsible for any of your confidential, proprietary, or personal information; lost or corrupted data; or damaged or lost removable media. Please only include the product components requested by the phone technician.

Enhanced service contracts may also be purchased from your representative.

 

Governing Law

This Agreement shall be governed by & construed & enforced firstly in accordance with & subject to the Constitution of InfoTelesys and secondly Common Law.  Common Law represents the will of the people & not that of the Judiciary, Executive office or Legislature.  A Common Law Trial By Jury is without judicial or State interference.
Pursuant to this Contract, Codes or laws not properly ratified by a two thirds majority of any populous or by representatives voted into office by less than two thirds of the population are not considered governing law (If a sufficient percent (50% represents a majority; 75% a quorum) of the population did not vote for representatives, then those representatives do not represent the people & clearly do not have sufficient authority to enact legislation.).  Parties agree to ban the BAR from all matters (BAR Association’s have commandeered control of most courts around the world and entrap people into a hopelessly unjust system of codes and judicial rulings which they attempt to pass of as precedence under English Common Law and where inefficiency and injustice ensures BAR members increased profitability).
Settlement of Disputes
All disputes arising from this Contract shall be settled through the Legal Due Process outlined herein.
In case no settlement can be reached through mediation, the parties agree that the dispute shall be submitted to a Common Law Court in a relevant district selected by InfoTelesys. The relevant expenses (including legal cost, travel expenses, mediation, notary fees, jury fees, cost of adducing evidence, expert witnesses and so on) shall be borne by the losing party.
Legal Due Process:
Both parties wish to maintain an honest & good relationship & agree to properly discuss any problems at senior levels prior to entering any legal action.  Both parties agree to the following Legal Due Process:

  1. That any and all legal action will be preceded with a formal Common Law Administrative Meeting where all parties gather to discuss the issues before opening any case.
  2. If the matter is not settled in the Administrative Meeting, Parties agree to enter and complete formal Mediation where both parties mutually select a mediator, if they cannot agree to a mutual mediator the parties each select independent mediators to attempt to resolve the problem.
  3. If the matter is not settled in Mediation the matter may be brought to Trial by Jury in a Common Law Court in conformance with the Governing Law of this agreement & managed according to Common Law Trial by Jury process: Parties are offered random jury selection of 12 jurors from a qualified expert jury pool, alternatively if the parties do not agree to the expert jurors 12 jurors shall be randomly from the district where the alleged violations took place; All jurors shall qualify for impartiality & subject matter expertise; Trials are conducted dynamically employing electronic means where possible without interference by BAR lawyers, State or judiciary.
  4. INFOTELESYS AND CUSTOMER UNDERSTAND THAT THEY ARE WAIVING ANY RIGHTS AND DENIAL OF RIGHTS IN A TRIAL BY JUDGE OR JURY IN A STATE OR BAR RUN COURT OR INSTITUTION.

INFOTELESYS AND CUSTOMER AGREE TO BE COMPLETELY BOUND BY COMMON LAW OUTSIDE OF ANY STATE OR BAR CONTROLLED COURT AND THAT NEITHER PARTY SHALL FILE ANY ACTION IN A STATE OR BAR COURT.
INFOTELESYS AND CUSTOMER AGREE TO FOLLOW THE LEGAL DUE PROCESS DEFINED HEREIN.
ALL PARTIES AGREE TO ABIDE BY AGREEMENTS & JUDGMENTS MADE THEREIN.
