One quickly realizes that the Patent Office's primary function is to collect patent registration fees (what a business!). With respect to the so-called right to challenge someone in court, one only has to realize that a huge amount legal cases brought before the courts have absolutely no bearing. In America people sue for the purpose of suing, you don't need any justification to sue. So the real value of patents and the ability to defend them is becoming seriously questionable in the modern world where almost everything can be proven to have been invented before in one shape or form. With totally global business without borders, patents are becoming practically unenforceable. Registering a patent is more like publishing your secret than creating a defendable business asset. With the volume of products being manufactured in China, we are already experiencing the reverse flow of technology. This leaves companies with a few basic options:
